Inleiding
- In dit artikel wordt beschreven in hoeverre rechters, advocaten en juristen op de hoogte zijn van wetenschappelijke bevindingen met betrekking juridisch bewijs en in hoeverre zij deze kennis toepassen in de praktijk.
Conclusie
- Hoewel experts graag willen dat hun geval wint in de rechtszaal, mag dit niet ten koste gaan van een objectieve manier van onderzoek doen.
- In zaken waarin de wet en de wetenschap beide voorkomen, moet de wettelijke juistheid van de rollen van de rechters en de experts geëvalueerd worden.
- Het bewijsmateriaal van medische experts hebben vaak invloed op de uitspraak van de rechter.
- Daarom moet op de juiste manier naar dit bewijs gekeken worden.
- Als laatste moeten rechters rekening houden met het feit dat experts als gevolg van een gebrek aan ervaring en/of een gebrek aan formele kwalificaties (zoals een bepaalde certificatie) niet in staat zijn om een goede verklaring af te leggen.
- De kwaliteit van de verklaringen kan verhoogd worden door de juiste training en door ervaring met soortgelijke gevallen.
- Een ander voorstel is dat medische experts de onderstaande gegevens over zichzelf moeten rapporteren aan de rechter:
- Algemene training of ervaring met kindermishandeling en verwaarlozing;
- Specifieke training of ervaring met een bepaald type kindermishandeling in de rechtszaal;
- Lidmaatschap van relevante professionele verenigingen;
- Relevante professionele publicaties.
- Hiermee kunnen experts aantonen in hoeverre ze verstand hebben van bepaalde medische kwesties.
- Het begrijpen van de wetenschap is belangrijk in gevallen van kindermishandeling, omdat het om het leven van het kind gaat.
