Casus
Van den Bos is in 1972 betrokken geraakt bij een verkeersongeval en hier gewond geraakt. In 1976 dagvaart hij Provincial (zijn verzekering) omdat zij uitbetaling weigerden. De zaak loopt nog als van den Bos in 1977 failliet raakt, de curator neemt de lopende zaak met Provincial niet over. Nadat het faillissement is opgeheven wordt, nadat de zaak lange tijd stil heeft gelegen, in 1986 het verval hiervan uitgeroepen. Van den Bos laat hierop lange tijd niks van zich horen totdat hij in 1989 Provincial opnieuw dagvaardt op basis van dezelfde gronden als in 1976.
Provincial beroept zich op rechtsverwerking. rechtsverwerking houdt in dat iemand een recht wordt ontzegd,vanwege zijn houding ten opzichte van de wederpartij. Dit kan alleen doordat iemand zich gedraagt op een wijze die naar redelijkheid en billijkheid onverenigbaar is met het betrokken recht.
Hoge Raad
In dit arrest onderscheidt de Hoge Raad twee gronden voor rechtsverwerking.
Bijzondere omstandigheden als gevolg waarvan; bij de schuldenaar het gerechtvaardigd vertrouwen is gewekt dat de schuldeiser zijn aanspraak niet meer geldend zal maken.
Bijzondere omstandigheden als gevolg waarvan; de schuldenaar onredelijk zou worden benadeeld of verzwaard als de schuldeiser zijn aanspraak alsnog geldend zou maken.
In casu oordeelt de HR dat Provincial er na zo'n lange tijd op mocht vertrouwen dat van den Bos zijn aanspraak niet meer geldend zal maken (rechtsoverweging 3.3).
