Muñoz (HvjEG 17-09-2002, Case C-253/00)
De Engelse rechter vraagt aan het HvJEG of aan bepalingen uit Verordeningen wel rechtstreekse werking toekwam tussen twee particulieren. Volgens de bewoordingen van art. 249 tweede alinea EG heeft een verordening algemene strekking en is rechtstreeks toepasselijk in elke lidstaat. Het hof antwoordde dus dat de verordeningen aldus moeten worden uitgelegd dat de naleving van de bepalingen m.b.t. de kwaliteitsnormen voor groente of fruit, moet kunnen worden verzekerd in een civiel proces van een marktdeelnemer tegen een concurrent.
