De regels uit het arrest Mulder q.q./CLBN gelden niet voor het geval waarin de bank als hypotheekhouder heeft ingestemd met een onderhandse verkoop van de verhypothekeerde onroerende zaak en de opbrengst daarvan op de bij de bank aangehouden rekening van de hypotheekgever worden bijgeschreven. Door afstand te hebben gedaan van het hypotheekrecht, is ook het daaraan verbonden recht van voorrang komen te vervallen en is de bank verworden tot een concurrente schuldeiser.
