Casus
Ajax c.s. hebben onder Reule conservatoir beslag gelegd op een partij caps, sjaals en mutsen, die waren voorzien van het Ajax logo en het woordmerk Ajax, maar niet van licentiestickers. In het door Ajax aangespannen kort geding vordert Reule c.s. in reconventie opheffing van het beslag.

Kan de eis in de hoofdzaak worden ingesteld in kort geding?
Hoge Raad
Conservatoir beslag wordt executoir beslag, zie art. 704 RV. In verband hiermee is aanvaard dat het instellen van de eis in de hoofdzaak, nu in kort geding een voor tenuitvoerlegging vatbare veroordeling tot voldoening van de vordering ter verzekering waarvan het beslag is gelegd kan worden verkregen.
