Soms leiden burgers schade door een besluit of andere feitelijke handelingen. Zowel onrechtmatig als rechtmatig overheidshandelen kan er voor zorgen dat iemand dan recht heeft op een schadevergoeding.
Bestuursrechtelijke onrechtmatigheid is civielrechtelijke onrechtmatigheid: als een besluit vernietigd is door de bestuursrechter is het dus op beide rechtsgebieden onrechtmatig. Als een besluit formele rechtskracht heeft, is het onaantastbaar: de mogelijkheden van bezwaar en beroep ertegen zijn verlopen dan wel verwerkt (bezwaar/beroep is afgewezen). Er wordt wel gesproken van “omgekeerde formele rechtskracht” in het geval dat een besluit door de bestuursrechter vernietigd is. Het wordt daardoor automatisch onrechtmatig geacht.
