Casus

Tussen Mali en Burkina Faso bestaat een verschil in mening met betrekking tot een grensgebied. Het staatshoofd van Mali heeft op 11 april een eenzijdige verklaring geuit.

Rechtsoverweging

Het internationale hof heeft in het arrest “Nuclear Tests” aangegeven dat bij eenzijdige verklaringen gewaakt moet worden tegen een te vrije interpretatie van feiten en omstandigheden van het geval.

Het Hof voegt hieraan toe in deze zaak dat voorzichtigheid met name betracht dient te worden indien een eenzijdige verklaring niet is gericht aan een zekere geadresseerde.
