Artikel 102 VWEU verbiedt een onderneming met een machtspositie tariefpraktijken toe te passen die leiden tot de uitsluiting van haar huidige of potentiële, ‘even efficiënte concurrenten’ – dat wil zeggen: praktijken die het voor deze laatsten moeilijker of zelfs onmogelijk kunnen maken om de markt te betreden en die het voor haar medecontractanten moeilijker of zelfs onmogelijk kunnen maken om tussen verschillende bevoorradingsbronnen of handelspartners te kiezen – en aldus haar machtspositie te versterken met behulp van andere middelen dan die welke berusten op een mededinging op basis van kwaliteit (zgn. ‘margin squeeze’).
