Marshall (HvJ 26-02-1986, Zaak 152/84)
Een lidstaat die de door een richtlijn voorgeschreven uitvoeringsmaatregelen niet tijdig heeft getroffen, kan het feit, dat hij zijn verplichtingen voortvloeiend uit die richtlijn niet is nagekomen, niet tegenwerpen aan particulieren. Verder kan een particulier, ongeacht in welke hoedanigheid de staat optreedt, overheid of werkgever, zich op een richtlijn beroepen tegenover de staat. In beide gevallen gaat het er immers om, dat de staat geen voordeel heeft van zijn miskenning van het gemeenschapsrecht.
