Een lidstaat mag niet de onderdanen van een andere lidstaat verwijderen of de toegang tot zijn grondgebied ontzeggen krachtens het openbare orde - voorbehoud van artikel 39 EG verdrag, wegens gedragingen die, indien door onderdanen van de eerste lidstaat begaan, geen aanleiding geven tot repressieve maatregelen, noch ook tot andere daadwerkelijke, op bestrijding van zulke gedragingen, gerichte maatregelen. Nogmaals; persoonlijk gedrag is uitsluitend het bepalend aspect.
