British Telecommunications (HvJ 26-03-1996, Zaak C-392/93)
Het Verenigd Koninkrijk had een richtlijn verkeerd omgezet. Het beginsel van aansprakelijkheid van lidstaten is inherent aan het verdrag. De voorwaarden zijn:
- toekenning van rechten aan een particulier voldoende gekwalificeerde verdragsschending causaal verband.
- De tweede voorwaarde moet worden bepaald aan de hand van duidelijkheid en nauwkeurigheid van de geschonden regel.
Het gaat dan bijvoorbeeld om een ernstige miskenning van de bevoegdheid. Het Hof oordeelde dat artikel 8 lid 1 van de richtlijn onnauwkeurig is. De uitleg van het Verenigd Koninkrijk druist namelijk niet kennelijk in tegen de letter of het doel van de richtlijn. In casu is er niet voldaan aan de voorwaarden voor voldoende verdragsschending.
