Partijen hebben zich gedurende ‘een lange reeks van jaren steeds en consequent’ gedragen naar het uitgangspunt dat hun huwelijksgoederenregime werd beheerst door Rhodesisch recht en dat zij mitsdien waren gehuwd buiten gemeenschap van goederen.
Bij deze stand van zaken is het volgens de Hoge Raad, tegen de achtergrond van de onzekerheid die destijds in het Nederlandse internationaal privaatrecht bestond met betrekking tot de vraag welke wet van toepassing is op niet onder het Haags Huwelijksgoederenverdrag 1905 vallende huwelijken, ‘naar maatstaven van redelijkheid en billijkheid onaanvaardbaar’ dat de man zich thans op het standpunt stelt dat de scheiding en deling dient plaats te vinden op basis van het uitgangspunt dat partijen in algehele gemeenschap van goederen waren gehuwd.
