Spreekplicht bij wederzijdse dwaling
Casus
Een edelsmid koopt een bekertje voor de zilverprijs n.a.v. de mededeling van een deskundige dat het om "niets bijzonders gaat". De koper maakt er een studie van, waarbij blijkt dat het een heel bijzondere beker is. De koper vordert vernietiging van de koopovereenkomst op grond van bedrog subsidiair op grond van dwaling.
Rechtsvraag
Kon de verkoper zich met succes op dwaling beroepen?
Hoge Raad
Naar het oordeel van de Hoge Raad moest de vordering van de verkoper worden afgewezen. Waar het in casu om draait is de vraag of de verkoper op de enkele grond, dat de zaak een eigenschap blijkt te bezitten waarvan hij ten tijde van de verkoop geen vermoeden kon hebben, vernietiging kan eisen, als aannemelijk is dat hij bij bekendheid met die eigenschap de zaak niet of tegen een hogere prijs zou hebben verkocht. Deze vraag moet ontkennend worden beantwoord omdat naar verkeersopvatting een verkoper die zijn zaak voor een bepaalde prijs van de hand doet, daarmee de kans, dat de zaak veel meer waard is, prijsgeeft. Dit is zeker het geval nu het feit dat het om een zeer bijzondere drinkbeker gaat te danken is aan een speciale studie van de koper. Had de koper bij voorbaat geweten dat het om een bijzonder stuk ging dat had hij een mededelingsplicht/spreekplicht gehad, dit vloeit voort uit de goede trouw.
