Adeneler (HvJ 04-07-2006, Zaak C-212/04)
Het Hof beoordeelde in deze zaak in hoeverre tijdelijke arbeidsovereenkomsten onbeperkt toegepast mogen worden. De betreffende lidstaat had een Richtlijn dat betrekking had op dit onderwerp te laat omgezet. De nationale rechter vroeg zich af vanaf welk moment hij de Richtlijn moet toepassen in zijn rechtspraak. Het Hof stelt dat de nationale rechter altijd zoveel mogelijk uitleg moet geven dat overeenkomt met het doel en de bewoording van de Richtlijn. Hoewel er begrenzing is door de rechtszekerheid en het verbod op terugwerkende kracht, moet hij toch alles doen wat hij kan om richtlijnconform te oordelen. Deze verplichting geldt vooral wanneer er geen rechtstreekse werking uitgaat van de Richtlijn.
