Vanwege de voor het huwelijksvermogensrecht, mede met het oog op de belangen van derden, geldende eis van rechtszekerheid en gemakkelijke hanteerbaarheid, is er bij de toepassing van de tweede trede van de Chelouche/Van Leer-verwijzingsregel geen ruimte voor een realiteitstoets (bij verwaterde nationaliteit) en/of effectiviteitstoets (bij meervoudige nationaliteit).
