Casus
Het betreft hier de verhuur van de serviceflat ’t Velthuys in Hattem. In deze flat hadden de bewoners de verplichting om maaltijden af te nemen. Maar indien de bewoners afwezig waren dan geldt deze verplichting niet doordat het reductiesysteem is ingevoerd. Bovendien had de exploitant het recht om het servicepakket te wijzigen.
Rechtbank
De Rechtbank heeft geoordeeld dat het verzorgingselement niet overheerst bij het verhuren van een serviceflat aan bewoners, het verzorgingselement is dus van ondergeschikt belang. De bewoners hebben bij het aangaan van de overeenkomst namelijk ingestemd met dat voorbehoud, hierdoor valt er af te leiden dat de omvang van het servicepakket niet doorslaggevend is voor de bewoner. De Hoge Raad kwam tot het volgende oordeel: Overeenkomsten die meer inhouden dan het verstrekken dan genot alleen zijn – thans – art. 232 -282 van toepassing, tenzij er sprake is van overheersing van het verzorgingselement. Het gevolg van dit oordeel was voor de bewoners gunstig, de servicekosten daalde namelijk met ongeveer 1600 gulden per maand.
