Casus
Het gaat om de vraag of er sprake is van een structurele wanverhouding tussen de huuropbrengsten en de exploitatiekosten. Dit moet worden beoordeeld in het kader van de aanwezigheid van een dringend eigen gebruik.
Hoge Raad
In dat kader is het hof ingegaan op de eventuele betekenis van nalatig onderhoud en wel in verband met de vraag of de renovatiekosten om die reden dienden te worden verminderd. Er bestaat weliswaar enige overlap tussen de vaststelling van dringend eigen gebruik en de belangenafweging op de voet van art. 7:274 lid 1 sub c, maar dat is onvoldoende om te oordelen dat het hof nog afzonderlijk aandacht had moeten besteden aan het argument ter zake van achterstallig onderhoud. Tot de omstandigheden die bij een beroordeling van een structurele wanverhouding tussen de huuropbrengsten en het exploitatietekort in aanmerking genomen mag worden behoort ook de waardestijging van het verhuurde, zoals die zich na de verwerving ervan heeft voorgedaan. De financiering van de exploitatie staat los van de vraag of er sprake is van een structurele wanverhouding tussen exploitatiekosten en de huuropbrengsten.
