Feiten
De klaagster, mevrouw Kadiatou Barry (1997), en haar dochtertje Binta Barry (2015), zijn onderdanen uit Guinee. Beide wonen in Emmen.
Mevrouw Kadiatou Barry klaagt dat haar dochter, die geboren is in Nederland, zou worden blootgesteld aan genitale verminking als zij terug zou moeten naar Guinee. Ook zijzelf zou geconfronteerd worden met mogelijke verminking. Dit zou schending opleveren van artikel 3 EVRM. Artikel 3 EVRM bevat het verbod op foltering en onmenselijke of vernederende behandeling of bestraffing. Uitzetting naar een land waar een persoon een reëel risico loopt op foltering of onmenselijke of vernederende behandeling of bestraffing is niet toegestaan.
In de tussentijd heeft de Nederlandse staat laten weten dat de dochter een vergunning zou krijgen en dat de moeder een vernieuwde asielprocedure kon initiëren. Op 5 juni 2018 heeft de klaagster de aanvraag dan ook ingetrokken.
EHRM
Het Hof stelt dat mevrouw Kadiatou Barry en haar dochter niet langer geconfronteerd worden met de uitzetting naar Guinee. In deze omstandigheden, en gelet op artikel 37, § 1, onder a en b van het EHRM, wordt de zaak stop gezet.
