Mothers of Srebrenica tegen de Staat der Nederlanden, 30 maart 2010, LJN BL8979

Casus

Stichting Mothers of Srebrenica klaagt Nederland en de Verenigde Naties (VN) aan voor de Nederlandse nationale rechter. Vraag in dit arrest is of deze wel bevoegd is te oordelen over de internationale organisatie. Artikel 105 lid 1 VN Handvest kent de VN immers immuniteit toe. Dit artikel noch de volkenrechtelijke praktijk leiden tot een beperking van de absolute immuniteit van de VN. De rechtbank verklaart zich dan ook onbevoegd in deze zaak.

De Stichting stelt onder meer dat aan de VN geen immuniteit toekomt, dit zou volgen uit artikel 14 IVBPR en artikel 6 EVRM. Deze artikelen geven het recht op toegang tot een onafhankelijke rechter, terwijl de VN hier niet voor kan worden gedaagd. De functionele immuniteit van de VN zou in casu zijn overschreden omdat het hier gaat om een schending van ius cogens, namelijk het verbod op genocide. Deze genocide vond plaats in Bosnië-Herzegovina onder de ogen van de VN, die dit niet heeft weten te verhinderen.

Het Hof

Al eerder heeft het Internationaal Gerechtshof (IGH) geoordeeld dat mogelijk onrechtmatig handelen van de VN niet voor beoordeling door nationale rechters vatbaar is. Ook in de Al-Adsani tegen Verenigd Koninkrijk zaak werd al door het EHRM beslist dat er geen algemeen aanvaarde norm is op grond waarvan immuniteiten moeten wijken voor ius cogens (waar genocide deel van uitmaakt). Dit arrest is van overeenkomstige toepassing. Ook artikel 6 EVRM is geen basis voor een uitzondering. Er is door middel van een beroep op artikel 6 EVRM dus geen recht op een nationale rechter mogelijk.
