Rechtsregel
Indien verhuurder zelf de oorzaak is dat hij de verhuurde bedrijfsruimte dringend nodig heeft, staat dat niet in de weg aan beroep op art. 296 lid 1 onder b BW. En ook het feit dat er voor de verhuurder alternatieven bestaan is pas een beletsel voor een beroep op ‘dringend persoonlijk gebruik’ als de huurder aannemelijk maakt dat het voldoende in de rede ligt om die andere mogelijkheden te benutten.
