Woonboerderij - Arrest

Woonboerderij (HR 28-01-2000, NJ 2000, 36c)

Feiten:

Van Dijk koopt op 23 augustus 1993 van Christiaanse een woonboerderij, waarbij in de overeenkomst is opgenomen een beding, welke de feitelijke eigenschappen garandeert, die voor een normaal gebruik nodig zijn. Tevens staat in een subbepaling van dit geding, dat de verkoper onbekend is met eventuele verontreiniging. In maart en april 1994 vinden bodemonderzoeken plaats, welke uitwijzen dat de grond om en nabij de schuur verontreinigd zijn. Van Dijk wilde voor zijn hobby juist deze schuur verbouwen, maar dat wordt nu praktisch onmogelijk omdat voor een bouwvergunning een schone grondverklaring vereist is en derhalve de grond rondom de schuur gesaneerd dient te worden. Van Dijk laat dan ook op 14 april 1994 bij het notariële transport verstek gaan. Christiaanse is in kort geding veroordeeld om de grond te laten saneren, waarop in juli 1995 de boerderij aan Van Dijk is overgedragen.

Nu Christiaanse op de hoogte was van het feit, dat Van Dijk de schuur wilde herbouwen in verband met zijn hobby, valt dit onder het beding, waarin het normale gebruik wordt gegarandeerd. Nu Van Dijk echter reeds enkele weken voor de transportdatum op de hoogte was van de bodemverontreiniging en de hierdoor voor hem ontstane consequenties, diende hij Christiaanse eerder dan door Van Dijk gedaan is, te weten één dag voor het transport, op de hoogte te stellen van de bodemverontreiniging en de daaraan verbonden consequenties.

 

Nu Van Dijk op deze wijze heeft gehandeld, kon Christiaanse het transport van zijn nieuwe woning niet meer uitstellen en diende derhalve een overbruggingskrediet te regelen. Uit de handelswijze van Van Dijk vloeit voor Christiaanse schade voort en dit had door Van Dijk beperkt dan wel voorkomen kunnen worden.
