Casus
Nadat er tussen de partijen een echtscheiding was uitgesproken heeft de Rechtbank te Den Haag besloten dat de moeder de voogdes is van de minderjarige kinderen en de vader tot toeziend voogd. Op 23 juni 1978 wordt bepaald dat de vader de kinderen eens in de twee weken op zondag ziet van 11:00uur tot 18:00uur. In kort geding vordert de vader naleving door de moeder van de bestaande omgangsregeling. Na onderzoek en tussenvonnis wijst de President bij vonnis de vordering van de vader in. Het hof bekrachtigd dit vonnis en moeder bestrijd in cassatie deze uitspraak.
In de cassatiemiddel vervatte klachten was de vraag of de rechter de bevoegdheid is gegeven voor hoofdveroordeling tot nakoming van verplichtingen uit het familierecht. Daarvoor moeten twee vragen beantwoord worden:
Is de bedoelde eenvormige wet ook van toepassing op gevallen waarbij hoofdveroordeling in de zin van art. 1 van die wet strekt tot nakoming van een verplichting uit het familierecht?
Als het antwoord nee dan heeft de Benelux-Overeenkomst twee strekkingen: 1. de mogelijkheid uit te sluiten dat in nationale wetgeving van een of meer van de drie landen de toepasselijkheid van de regeling die onder A bedoelde gevallen wordt uitgebreid of 2. een dergelijke uitbreiding slechts toelaten als de betreffende nationale wetgever zich uitdrukkelijk heeft uitgelaten in die zin.
Conclusie
De Hoge Raad komt tot de conclusie dat de Eenvormige wet betreffende de dwangsom ook van toepassing is in het geval waarin de hoofdveroordeling in de zin van art. 1 van de wet strekt tot nakoming van een verplichting van het familierecht, waarvan in deze casus sprake is.
