Velpse Duivenhok

Casus:
Een man krijgt in 1993 een vergunning van het bestuur van de gemeente Velp voor het uitbreiden van een garage om zodoende een duivenhok te kunnen houden. De buren van de man ondervinden hier echter behoorlijke last van. Zo blijken ze naast geluidshinder en hinder van de uitwerpselen, ook last te hebben van gezondheidsklachten die veroorzaakt worden door de duiven.
De buren hebben nadat hun bezwaar ongegrond is verklaard, beroep ingesteld bij de rechtbank. De rechtbank heeft de buren niet in het gelijk gesteld, waarna ze in hoger beroep zijn gegaan bij de Afdeling Bestuursrechtspraak van de Raad van State.
Rechtsvraag:
Is er in casu te weinig rekening gehouden met de belangen van de buren waardoor er onvoldoende sprake is van een goede belangenafweging?
ABRvS:
De klachten van de buren zijn terecht niet ontvankelijk verklaard door de gemeente en de rechtbank. Dit komt doordat zij geen belanghebbende zijn, aangezien ze niet rechtstreeks betrokken zijn bij het bestemmingsplan. Er is dus in overeenstemming gehandeld met het specialiteitsbeginsel (art. 3:4 lid 1 AWB). Dit wil echter niet zeggen dat de belangen van omwonenden helemaal niet moeten worden meegewogen (art. 3:2 AWB). Zo zijn er andere middelen die het nadeel van de omwonenden moeten kunnen compenseren om zodoende niet het evenredigheidsbeginsel te schenden (art. 3:4 lid 2 AWB).
