Van den Bergh / Staat (HR 27-01-1961, NJ 1963, 248)

Casus

De Staat kort het (Kamerleden)pensioen van voormalig Kamerlid Van den Bergh. Dit besluit wordt gebaseerd op een formele wet, waarvan Van den Bergh in rechte beweert dat het niet op grond-wettelijke wijze is tot stand gekomen, en derhalve onverbindend zou zijn.

Rechtsvraag

Mag de rechter de wijze van totstandkoming van een formele wet aan de Grondwet toetsen?

Hoge Raad

Er bestaat geen reden verschil te maken tussen de vraag of de inhoud van een wet in overeenstemming is met de Grondwet, en die of bij de totstandkoming van de wet de door de Grondwet voor de wetsvorming voorgeschreven procedure in acht is genomen.

Uitsluitend de wetgever zelf beoordeelt de vraag met welke bepalingen van de Grondwet bij het tot stand brengen van wetten moet worden rekening gehouden en hoe die bepalingen moeten worden uitgelegd en toegepast. De rechter mag deze vraag dus niet beoordelen.

Als uit de Handelingen van de Staten-Generaal ondubbelzinnig volgt dat naar het oordeel van elk van de beide Kamers het ontwerp van die wet door die Kamer in overeenstemming met de Grondwet is aangenomen, dan is die wet in overeenstemming met de Grondwet tot stand gekomen.

In het arrest Prof. van den Bergh (HR 27 januari 1961, NJ 1963, 248) oordeelde de Hoge Raad dat het toetsingsverbod van artikel 120 Grondwet met zich brengt dat de rechter de inhoud van een wet in formele zin niet mag toetsen aan de Grondwet, maar wel de wijze waarop de wet tot stand is gekomen.
