Casus
Het ging hier om de in 2008 gedane verklaring van onafhankelijkheid door Kosovo. Door de verklaring is dit gebied reden voor een twist tussen Servië en de Republiek van Kosovo.
Court of Justice
Zij verklaarde dat de onafhankelijkheidsverklaring van Kosovo niet in strijd is met internationaal recht, aangezien het internationale recht hier geen verbod voor bevat. Ook was zij niet in strijd met resolutie 1244 van de Security Council.
In de praktijk bleken de meningen van andere staten over de kwestie verdeeld. In de praktijk bracht het de vraag in de internationale politiek of dit ook zou gelden voor andere afscheidingsbewegingen binnen staten.
