Casus
Het gaat hier om de eigendom van certificaten die deel uitmaken van een algemene effectenvoorraad. Mulder en Peijnenburg geven elke effecten in bewaring aan Texeira. Vóór 1 januari 1966, ten tijde van de casus dus, hoefde Texeira volgens de algemene voorwaarden nog niet voor iedere cliënt afzonderlijk de effecten te reserveren. De effecten stonden niet op nummer gereserveerd. In deze procedure gaat het om vaststelling welke effecten bij uitlevering aan Peijnenburg toekomen en welke aan Mulder.

Laat ons recht eigendom van slechts naar de soort bepaalde zaken toe?
Uitspraak
HR antwoordt ontkennend.
De stel- en bewijsplicht over de eigendom van de certificaten ligt niet bij Texeira. Nu de aandelen deel uitmaken van de algemene effectenvoorraad van Texeira gelden ze als haar eigendom. Er kan niet worden vastgesteld dat het om dezelfde aandelen gaat als door de eisers in bewaring zijn gegeven. Ook is niet duidelijk of Texeira voor eisers is gaan houden, voor ieder van hen afzonderlijk of voor hen tezamen. Bewijslast dat de ‘goederen’ van degene zijn die ze revindiceert, ligt bij diegene.
Als iemand een onder een ander berustende roerende zaak als zijn eigendom opvordert, is gemotiveerd ontkennen dat het goed aan de eiser toebehoort voldoende.
