Tankstation - Arrest

Tankstation: HR 4 november 2003 (LJN AL6171)

Casus

Verdachte heeft een overtreding van art 8.40 lid 1 Wet Milieubeheer begaan en is veroordeeld tot een geldboete. Verdachte klaagt over het feit dat het gelijkheidsbeginsel is geschonden, omdat hij, de eigenaar/verhuurder, wel wordt vervolgd en de huurder/exploitant,  die in vrijwel precies overeenkomende omstandigheden verkeert, niet. Tevens klaagt hij over het feit dat er een onjuiste uitleg wordt gegeven aan de zin “degene die een tankstation drijft” in art. 3 Besluit Tankstations Milieubeheer. Rechtsvraag was vervolgens: ‘Is verdachte de natuurlijke persoon die het tankstation drijft of is de huurder/exploitant dat?’

Hoge Raad

Het hof heeft, op grond van de volgende, uit de bewijsmiddelen blijkende feiten geoordeeld dat verdachte een ‘zodanige zeggenschap’ had met betrekking tot het tankstation, dat hij kon worden aangemerkt als ‘degene die een tankstation drijft’:

  • verdachte was de eigenaar van het tankstation;

  • verdachte ondernam alle activiteiten om een nieuw en aan alle eisen voldoend tankstation te realiseren;

  • blijkens de verklaring van de huurder/exploitant van het tankstation heeft verdachte opdracht gegeven tot het aanleggen van de noodinstallatie;

  • verdachte heeft bij brief van 13 juli 2000, gericht aan de Regiopolitie Groningen, bevestigd dat hij die opdracht heeft gegeven.

De omstandigheid dat verdachte blijkens zijn verklaring geen huur ontving tijdens de verbouwing van het tankstation maakt het voorgaande niet anders.

Dat oordeel geeft niet blijk van een onjuiste rechtsopvatting

De Hoge Raad verwerpt het beroep.
