Soering t. Verenigd Koninkrijk (EHRM 7 juli 1989, NJ 1990, 158 m.nt. E.A. Alkema)          

Het EVRM is toepasselijk op beslissingen in verband met de uitlevering, ook indien er moet worden uitgeleverd aan een land dat niet bij het EVRM is aangesloten (hier: de Verenigde Staten). Individuen die zich feitelijk binnen de rechtsmacht van een EVRM-lidstaat bevinden moeten óók worden beschermd tegen de inbreuken op hun mensenrechten die buiten het grondgebied van die lidstaat dreigen plaats te vinden.      

De toetsing van de omstandigheden in het verzoekende land aan de maatstaven van artikel 3 EVRM is onvermijdelijk; het is echter uitsluitend de aansprakelijkheid van de uitleverende verdragsstaat welke hier (mogelijkerwijs) in het geding is.       

Het EHRM oordeelde dat een dreigende schending moest worden aangenomen, hoezeer de duur van het verblijf in (deze) ‘death row’ (verblijf in de ‘dodengang’; wachten op de doodstraf) ook bepaald werd door de beschikbaarheid van velerlei rechtsmiddelen en andere voorzieningen waarmee een integer en op rechtsbescherming gericht juridisch stelsel het opleggen van de doodstraf omgaf.      

Het EHRM sluit voorts niet uit dat bij wijze van uitzondering artikel 6 EVRM in het geding komt door een uitleveringsbeslissing in gevallen waarin de voortvluchtige te maken heeft gehad of zou kunnen hebben met een flagrante miskenning van zijn recht op een eerlijk proces in het verzoekende land.
