Casus

Het gaat hier om de vraag of eiseres (Shamshum) tijdig verzet heeft gedaan tegen haar veroordeling bij verstek, in cassatie wordt er niet over geklaagd dat het hof art. 81 (oud) had behoren toe te passen.

Hoge Raad

In gevallen waarin het vonnis niet in persoon is betekend, geldt als maatstaf of de veroordeelde enige daad heeft gepleegd ‘waaruit noodzakelijk voortvloeit dat het vonnis of de aangevangen tenuitvoerlegging aan hem bekend is’ (art. 143 lid 2 Rv).

Deze maatstaf houdt in dat de veroordeelde zelf een handeling moet hebben verricht waaruit ondubbelzinnig valt op te maken dat hij over voldoende gegevens met betrekking tot (de inhoud van) zijn veroordeling beschikt om zich daartegen tijdig en adequaat te kunnen verzetten.
