Casus
Sejdic en Finci zijn burgers van Bosnia and Herzegovina. De Bosnische constitutie maakt onderscheid in twee soorten burgers; consistente burgers en anderen (minderheden als Joden). Dhr Finci wilt meedoen aan de verkiezingen van het Parlement, echter wordt zijn aanvraag hiertoe afgewezen omdat hij Joods is en dus niet in aanmerking komt voor een verkiezing.
Rechtsvraag
Is een afwijzing in strijd met de artikelen 3, 13,14 EVRM, artikel 3 Protocol 1 en artikel 1 Protocol 12?
Hof
Het hof voert aan dat er in deze zaak sprake is van een vorm van discriminatie. Er is sprake van discriminatie volgens het Hof wanneer bepaalde personen anders worden behandeld zonder een ‘objective and reasonable justification’. De staat wordt veroordeeld tot een boete.
