Casus
Het gaat in dit arrest van de Hoge Raad om een verdachte die in een druk, Amsterdams café het slachtoffer heeft neergeschoten. Vervolgens hebben omstanders de verdachte vastgepakt om hem te weerhouden van meerdere schoten. Ten gevolge hiervan is er nog een slachtoffer gevallen.
Het Hof
Het Hof oordeelde in deze zaak dat de verdachte door in de genoemde omstandigheden zijn wapen vast te blijven houden, zich willens en wetens heeft blootgesteld aan de aanmerkelijke kans dat het vuurwapen zou afgaan en een ander zou worden getroffen.
Hoge Raad
De Hoge Raad is het eens met het Hof. Volgens de Hoge Raad heeft de verdachte zich, gelet op de omstandigheden, willens en wetens blootgesteld aan de aanmerkelijke kans dat hij een andere bezoeker dodelijk zou treffen. Het opzet van de verdachte was dus voorwaardelijk gericht op dat gevolg. De stelling van verdachte dat het wapen per ongeluk is afgegaan, gaat niet op.
