Gefailleerde heeft de rechtbank verzocht de toepassing van de schuldsaneringsregeling uit te spreken. De rechtbank heeft het verzoek afgewezen. Tegen dit vonnis heeft gefailleerde hoger beroep ingesteld. Het hof het bestreden vonnis bekrachtigd, daartoe overwegende dat
gelet op de stukken van het geding en het verhandelde ter terechtzitting het vonnis van de rechtbank moet worden bekrachtigd. Niet aannemelijk is dat gefailleerde ten aanzien van het ontstaan of onbetaald laten van schulden te goeder trouw is geweest. Bovendien heeft gefailleerde niet de vrees kunnen wegnemen die op grond van zijn handel en wandel in het verleden is ontstaan, dat hij zijn uit de schuldsaneringsregeling voortvloeiende verplichtingen niet naar behoren zal nakomen. Tegen het arrest van het hof heeft gefailleerde beroep in cassatie ingesteld. 

Hoge Raad:   
Volgens artikel 288 lid 1 aanhef en onder b Fw kan (thans ‘wordt’) het verzoek tot toepassing van de schuldsaneringsregeling worden afgewezen, indien aannemelijk is dat de schuldenaar ten aanzien van het ontstaan of onbetaald laten van schulden niet te goeder trouw is geweest. Het hof heeft kennelijk beoogd deze maatstaf aan te leggen in zijn overweging dat niet aannemelijk is dat gefailleerde ten aanzien van het ontstaan of onbetaald laten van schulden te goeder trouw is geweest. Dit blijkt ook uit de bekrachtiging van het desbetreffende oordeel van de rechtbank. Ook mocht het hof ook acht slaan op stukken, ingestuurd namens de faillissementsaanvrager.
