Casus
Milutinovic dagvaardt de Raad van de Kinderbescherming te Zutphen en vordert de hele/gedeeltelijke opheffing van het executoriaal beslag wat door de RvdK ten laste is gelegd. De RvdK voert verweer en de rechtbank verklaart de vordering niet-ontvankelijk.
De RvdK gaat in hoger beroep bij het Hof te Arnhem en vraagt daarbij vernietiging van het vonnis en het alsnog in rekening brengen van de kosten.
De RvdK brengt aan dat Milutinovic in het vonnis van 1984 in het ongelijk is gesteld en daarom stelt de RvdK dat op die grond zij vernietiging van deze vordering kunnen aavragen. In hoger beroep wordt geen gehoor gegeven aan de klacht van de RvdK. Uit de processtukken bleek niet dat er een uitspraak over de kosten werd verwacht, dus Milutinovic wordt in ongelijk gesteld maar er wordt geen uitspraak gedaan over de kosten.
In cassatie wordt naar voren gebracht de schending/verkeerde toepassing van het recht en dat daarom alsnog de ongelijk gestelde partij in de kosten te veroordelen volgens art. 56 lid 1 Rv. Dit wordt door de Hoge raad gezien als gegrond.
De Hoge Raad
Het arrest van het Hof van Arnhem en het vonnis van de Rechtbank in Zutphen worden vernietigd en Milutinovic wordt als in ongelijk gestelde partij alsnog veroordeeld in de kosten van het geding en het hoger beroep.
