Casus
Rotterdam en Utopia hebben een huurovereenkomst gesloten met betrekking tot het voormalige D.W.L. gebouwencomplex. De gesloten huurovereenkomst zag op meerdere ruimtes die voornamelijk worden gebruikt als woonruimte c.q. bedrijfsruimte in de zin van art. 7:230a BW (de zogenaamde 230a-bedrijfsruimte). De overige ruimtes werden gebruikt als de zogenaamde art. 7:290-bedrijfsruimte. Partijen konden geen overeenstemming bereiken over de huurprijsvaststelling van de 290 bedrijfsruimte. Daardoor rees de vraag welk huurregime van toepassing is en in het bijzonder of de 290-bedrijfsruimte kon worden afgesplitst, zodat het huurregime van art. 7:290 BW van toepassing zou zijn.
Hoge Raad
De Hoge Raad heeft een eigen maatstaf geformuleerd voor de beantwoording van de splitsvraag. De rechter dient acht te slaan op alle omstandigheden van het geval, waaronder het gebruik dat partijen bij het sluiten van de overeenkomst voor ogen heeft gestaan, het gebruik dat thans van het gehuurde is gemaakt, de inrichting van het gehuurde in relatie tot dat gebruik, en de gevolgen van een eventuele splitsing voor het gebruik door de huurder.
