Casus
X is verzoeker van de cassatie tegen de gemeente Lelystad (niet verschenen verweerster). De rechtbank bepaalt dat X elke maand een bijdrage doet aan de gemeente, vanwege de kosten die de Gemeente heeft i.v.m. bijstand.
Aan de voet van de beschikking is vermeld dat twee maanden na de dag van uitspraak hoger beroep kan worden ingesteld bij het Hof te Arnhem.
Op 31 oktober 1994 is het eerste verzoek van de gemeente bij de Rechtbank te Zwolle ingediend. Toen was het procesrecht van voor 1 april 1995 geldig. Dit bracht met zich mee dat het beroepstermijn 3 weken is en niet 2 maanden. Op de openbare zitting 15 juni 1995 heeft de rechtbank de Gemeente in gelijke gesteld en op 24 juli 1995 komt het beroepschrift te griffie binnen. Dit is over het beroepstermijn van 3 weken heen en daarom niet worden ontvangen in zijn hoger beroep.
Na mondelinge behandeling van de zaak op 26 oktober 1996 heeft de advocaat van X 15 november 1995 een brief gezonden aan het hof met de vraag of X ontvankelijk was in zijn appèl. Vervolgens op 21 november 1995 is X wegens termijnoverschrijding niet-ontvankelijk verklaard.
Bij de cassatie voert X twee middelen. Namelijk de fout van de griffier 15 juni 1995 over de foute vermelding van het termijn en er wordt beroep gedaan op de verschoonbaarheid van de termijnoverschrijding.
In het bestuursrecht hoeft nou eenmaal een foutieve Rechtsmittelbelehrung niet leiden tot de verschoonbaarheid van een termijnoverschrijding.
Wel wordt vernoemd dat X nu slachtoffer wordt van fouten die worden gemaakt door personen die beter moeten weten: de griffier en zijn advocaat.
Hoge Raad
Beide redenen zijn geen rechtsgronden en daarmee verwerpt de Hoge Raad het beroep.
