Rechterlijk uitzendverbod - Arrest

Rechterlijk uitzendverbod (HR 02-05-2003, NJ 2004, 80 / LJN AF3416)

Casus

Storms was presentator van televisieprogramma ‘Breekijzer’ waarin hij onverhoeds bij bedrijven binnenviel waar volgens hem misstanden zouden plaatsvinden. Dit deed hij ook bij Niessen. In kort geding vroeg deze van de rechter een verbod om de betreffende opnames uit te zenden.

Rechtsvraag

Kan in casu een rechterlijk verbod worden verkregen tegen het uitzenden van het programma, ook al levert dit censuur op?

Hoge Raad

Het stond volgens de Hoge Raad vast dat Storms voor zijn programma onrechtmatig had gehandeld tegenover Niessen (in strijd met de wet). Daarom achtte de Hoge Raad een rechterlijk uitzendverbod toelaatbaar. De Hoge Raad zocht hiervoor aanknopingspunten in art. 7 lid 1 en 3 Grondwet. Hierin is de zinsnede ‘behoudens ieders verantwoordelijkheid volgens de wet’ opgenomen. Deze verantwoordelijkheid heeft ook zijn gelding in lid 2, volgens de Hoge Raad. Storms had in strijd met zijn wettelijke verantwoordelijkheid gehandeld, en dan gaat het verbod op preventieve censuur niet op.
