Rechtsregel
Artikel 4:46 lid 1BW heeft dat conform artikel 68a OBW onmiddellijke werking en ingevolge eerstgenoemd artikel dient bij de uitleg van uiterste wilsbeschikkingen te worden gelet op de verhoudingen die de uiterste wil kennelijk wenst te regelen en op de omstandigheden waaronder de uiterste wil is gemaakt.
Met betrekking tot de uitlegging van uiterste wilsbeschikkingen (die zijn gemaakt vóór de invoering van het nieuwe recht door iemand die nadien overlijdt) is het recht dat gold toen de uiterste wil werd gemaakt een omstandigheid in de zin van artikel 4:46 lid 1 BW.
Als uitgangspunt bij de uitleg heeft te gelden dat met betrekking tot de terminologie die de erflaatster heeft gebruikt het oude recht in beginsel bepalend is.
Bij de door erflaatster gebezigde erfrechtelijke termen als ‘legitieme portie’ en ‘wettelijk erfdeel’ speelt uitleg een rol. Een in de legitieme stelling in een onder het oude erfrecht opgemaakte uiterste wil, waarbij de nalatenschap onder het huidige recht is opengevallen moet worden begrepen als de benoeming van de legitimaris tot erfgenaam voor zijn naar oud recht geldende legitimaire breukdeel.
