Prosecutor v. Radislav Krstic (International Criminal Tribunal for the Former Yugoslavia 19-04-2004, IT-98-33-A)
Casus
In 1995 viel Srbrenica onder de verantwoordelijkheid van het Drina Corps, onderdeel van het leger van de Republiek Servië. In 1995 werd er door eenheden van het leger genocide gepleegd in Srbrenica. Krstic was in deze tijd een commandant in dit leger en van het Drina Corps. Hij werd aangeklaagd voor het (mede)plegen van genocide.
Trial Chamber
Krstic erkende dat er oorlogsmisdaden gepleegd waren door de VRS, maar gaf aan deze acties niet bevolen te hebben en pleitte onwetend te zijn.
Er werd door de Trial Chamber gekeken naar het begrip genocide. Cruciaal hierbij was dat er gehandeld was met de intentie om een deel van een groep te vernietigen. Het was niet noodzakelijk dat het de intentie was om de gehele groep te vernietigen, omdat de Serviërs wisten dat de handeling een blijvende impact op de groep zou hebben. Krstic werd veroordeeld wegens het plegen van genocide, omdat de leden van het leger het gezamenlijke doel hadden om een deel van de groep te vernietigen en Krstic verantwoordelijkheid uitoefende vanwege zijn rank. Hij werd veroordeeld tot 46 jaar cel, maar ging in beroep tegen dit oordeel.
Appeal Chamber
In Hoger Beroep werd nogmaals gekeken naar de definitie van genocide. Bevestigd werd dat er genocide gepleegd was in Srbrenica. Krstic werd echter slechts als medeplichte gezien. Zijn rol bestond uit het helpen en medeplegen van de genocide en niet in het starten van deze handeligen. Krstic wist wat hij deed en liet het, als commandant zijnde, gebeuren, ook al lijkt het bewijs er op te wijzen dat hij het plan niet steunde. Hij werd veroordeeld tot 35 jaar cel.
