Er is sprake van een prijzenbeschikking die in strijd is met de prijzenwet. De beschikking kan niet worden ingetrokken, want alleen de wetgever kan dat doet.

Wat kan de rechter doen met de onverbindende beschikking?

De kortgeding rechter (burgerlijke rechter) kan de beschikking buiten werking stellen en dus onverbindend verklaren indien de beschikking onmiskenbaar onverbindend is. Bovendien mag er geen andere rechtsgang open staan met dezelfde of met meer rechtsbescherming (zie het Changoe - arrest).
