Casus
Tijdens het politieverhoor, maakten de ambtenaren schietbewegingen bij het hoofd van de verdachte en zeiden zij dat 'wij gaan knippen en plakken' en dat de rechtbank voor waar aan neemt wat tegen 'hou pleit'. Het Hof achtte deze verhoormethodes deels onrechtmatig, wat leidde tot strafvermindering van zes maanden.

Wanneer is er sprake van ongeoorloofde pressie in het politieverhoor?
Hoge Raad
De Hoge Raad oordeelt dat de politie tijdens het verhoor enige drang uit mag oefenen, maar geen dwang. Volgens de Hoge Raad heeft het hof de schietende bewegingen en de mededeling over het ‘knippen en plakken’ ten onrechte niet onrechtmatig geacht. Het is, met het oog op de waarheidsvinding, belangrijk dat de onrechtmatigheden in deze zaak geen effect hadden. Als het tot een onbetrouwbare verklaring had geleid, had het bewijs moeten worden uitgeloten. Het Zwolsman-criterium werd aangedragen om te bekijken of het optreden tot niet-ontvankelijkheid had moeten leiden, met het oog op het recht op een eerlijk proces. Dit heeft het Hof gedaan en de Hoge Raad vindt het niet onbegrijpelijk dat er geen reden werd aangenomen tot het niet-ontvankelijk verklaren van de verklaring. Het optreden van de politie was niet zodanig dat het recht op een eerlijk proces te kort is gedaan en het Openbaar Ministerie als niet-ontvankelijk verklaard moet worden. In deze zaak was het nadeel door de schending gering. Strafvermindering acht de Hoge Raad niet nodig.
