Ongeval met brandpasta (Hof Arnhem 5 april 2011, LJN BQ1826; JA 2011/110)
Casus
Tijdens een feest in de tuin van X stonden op een tafel in die tuin drie warmhouders. Onder elk van de warmhouders stonden twee branders, metalen potjes gevuld met brandgel of brandpasta. X en Y hebben tijdens een feest brandwonden opgelopen doordat zij brandpasta over zich heen hebben gekregen. X en Y hebben onder meer de producent van de brandpasta aansprakelijk gesteld. X en Y achten de brandpasta een gebrekkig product in de zin van artikel 6:185 en 6:186 BW vanwege het ontbreken van een waarschuwing tegen het risico dat in de verpakking van de brandpasta, als gevolg van plaatsing in de zon, een brandbare alcoholdamp kan ontstaan die, bij uitschakelen in de buurt van open vuur, een explosie, althans een steekvlam kan veroorzaken.
Hof
Het hof oordeelt dat de etiketten waarschuwen tegen het door X en Y gestelde gevaar – het na plaatsing in de zon uitschenken in de buurt van open vuur – hetzij met de woorden: “Verwijderd houden van ontstekingsbronnen – Niet roken.”, hetzij met de woorden: “Licht ontvlambaar, niet bij open vuur houden”. Het ontbreken van een expliciete waarschuwing tegen het in de zon plaatsen heeft dan ook niet tot gevolg dat de brandpasta als ‘gebrekkig’ dient te worden aangemerkt.
Bovendien oordeelt het hof dat de vordering van X en Y niet toewijsbaar is, omdat voor aansprakelijkheid van de producent voor schade als gevolg van het gebruik van een gebrekkig product vereist is dat de schade het gevolg is van het gestelde gebrek daaraan. In dit geval is dit niet komen vast te staan.
