Casus
Het betreft hier een benzinestation die door BP is verhuurd aan Obotel. Het betreft een vorderering van BP tot nadere huurprijsvaststelling op de voet van art. 7A:1632a oud BW in zake het door BP aan Ototol verhuurde tankstation. De huurovereenkomst voorzag aan de wijzigingsvordering die nu ter beoordeling staat, in een huurprijs berekend naar 1,6 hulden-centen per liter via het tankstation verkochte brandstof. BP vordert in deze zaak op voet van art. 7A:1632a oud BW verhoging van de geldende huurprijs met ingang van 15 augustus 2001.
Hoge Raad
Het hof kwam na enige beschouwingen, tot een deels schattenderwijs verrichte vaststeling van de huurprijs 75.00 euro per jaar, jaarlijks conform de prijsindex aan te passen.
