Casus
Taams heeft Boudeling gedagvaard. Boudeling zou Taams een klap hebben gegeven, waarvoor hij medisch moest worden behandeld en blijvend letsel zou hebben opgelopen. Hij vordert dan ook een groot bedrag aan immateriële schade. De partijen verschillen dusdanig van mening over het verloop van de schermutseling dat de volgende rechtsvraag naar voren komt:
Wat is de bewijskracht van een partij-getuigeverklaring?
Hoge Raad
Vóór 1988 konden partijen niet zelf als getuige worden gehoord, omdat de wetgever de tweestrijd tussen zijn eigen belang en de plicht om op alle vragen naar waarheid te antwoorden wilde voorkomen. Dit was in strijd met het beginsel van gelijke rechten in de civiele procedure. In 1993 besloot het EHRM in het DOMBO-arrest dat het beginsel van equality of arms in art. 6 EVRM betekent dat partijen de gelegenheid moeten krijgen om hun zaak te presenteren, inclusief het bewijs.
In dit arrest laat de Hoge Raad zich uit over deze uitleg van art 6 EVRM en zegt dat deze slechts ziet op de toelating van de partijgetuigenverklaring als bewijsmiddel en houdt zij geen veroordeling in van haar beperkte bewijskracht.
Deze beperkte bewijskracht houdt in dat de partij met de bewijslast kan niet enkel volstaan met een verklaring van een partijgetuige. Er moet wel verder aanvullend bewijs zijn. Deze regel staat in art. 164 lid 2 RV. Het aanvullende bewijs moet zodanig sterk zijn en essentiële punten bevatten dat het de partijverklaring voldoende geloofwaardig maakt. De beoordeling van het bewijs is aan de rechter overgelaten, art. 152 RV.
