Casus
Het gaat in deze zaak om de toepasselijkheid van artikel 6 EVRM in procedures betreffende voorlopige maatregelen.
Europees Hof voor de Rechten van de Mens
Artikel 6 EVRM is ook van toepassing op een procedure over voorlopige maatregelen indien zowel in die procedure als in de hoofdzaak een ‘burgerlijk’ recht in het geding is en de voorlopige maatregel van bepalende betekenis is voor dat recht. In uitzonderlijke gevallen, zoals wanneer de maatregel slechts effectief kan zijn bij snelle besluitvorming, kan van artikel 6 EVRM worden afgeweken, maar dat geldt niet voor het recht op berechting door een onafhankelijke rechter.
