Zorgvuldigheidsbeginsel, motiveringsbeginsel, schadevergoeding
Appellant Kradolfer is houder van een snackbar. De snackbar heeft een zogenaamde muziekvergunning, die benodigd is om muziek te mogen spelen. Wegens geluidsoverlast trekt de burgemeester de vergunning in voor een periode van twee weken, bij wijze van correctiemaatregel. Kradolfer dient een bezwaarschrift in, de burgemeester verklaart dit bezwaar ongegrond.
De klachten over geluidsoverlast kwamen slechts van één persoon, mevrouw Cupido, die boven de snackbar woonde. De politie stelde op het gehoor, dus niet middels een objectieve meting van het geluidsniveau, vast dat de klacht inderdaad gegrond was.
Dit is in strijd met het zorgvuldigheidsbeginsel, mede gelet op de gewichtige belangen van appellant.
Ook in strijd met het zorgvuldigheidsbeginsel is het feit dat de gemeente tekort is geschoten door in het besluit tot intrekking geen bezwaartermijn en geen beroepsmogelijkheid te vermelden. Omdat het besluit niet wordt gedragen door een goede motivering, de feitelijke grondslag blijkt niet uit het besluit, is het ook in strijd met het motiveringsbeginsel.
De afdeling veroordeelt de gemeente tot schadevergoeding.
