Feiten
Max Verstappen is een professioneel autocoureur. Hij speelt in een reclame van supermarkt Jumbo, waarin Verstappen de boodschappen thuis bezorgt bij de klanten in zijn race-auto. Hiermee promoot Jumbo haar snelle bezorgdienst. Picnic is een online supermarkt waarbij klanten via internet, en dus niet fysiek, boodschappen kunnen bestellen om ze vervolgens door Picnic thuis te laten bezorgen. Picnic heeft op haar facebookpagina een reclamefilmpje gepost. Hierin is een lookalike te zien van Verstappen die de boodschappen bezorgt. De lookalike draagt in het filmpje van Picnic dezelfde outfit en heeft dezelfde pet op die de echte Max Verstappen altijd draagt.
Rechtsvraag
Is het gebruik van de lookalike in het filpje van Picnic onrechtmatig t.o.v. Max Verstappen?
Oordeel
De rechtbank oordeelt dat het gebruik van de lookalike in het filmpje onrechtmatig is t.o.v. Max Verstappen. Dit is omdat Picnic het portretrecht van art. 21 Aw heeft geschonden, ondanks het feit dat er alleen een lookalike is gebruikt. Dit is omdat de lookalike alle kenmerken van Max Verstappen heeft vertoond in het filmpje. Hieruit kan worden opgemaakt dat Picnic opzettelijk het beeld van Max Verstappen wilde oproepen. Max Verstappen heeft ook een commercieel belang om zich tegen het gebruik van de lookalike te verzetten. Verstappen heeft als gevolg immers schade geleden.
