Rechtsregel
Oplegging van strenge zorgplicht aan fabrikant. Voor wat betreft de voorzienbaarheid moet worden gelet op het gehele publiek.
Casus
Baby loopt brandwonden op. Jumbo laat een aantal kruiken bij TNO onderzoeken. Het Hof gaat af op dat rapport, en concludeert dat Jumbo niets te verwijten valt. Bij de Hoge Raad wordt geklaagd dat het Hof een uitspraak heeft gedaan over kruiken in het algemeen, en niet in het bijzonder over de onderhavige, die, volgens TNO, een slecht passende dop had.
Hoge Raad
Overweegt o.a.: "dat toch (...) de fabrikant, zo aan de voorwaarden voor zijn aansprakelijkheid overigens is voldaan, er zich ter bestrijding daarvan in het algemeen niet op zal kunnen beroepen dat het ongeval niet zou zijn voorgevallen, zo alle voorzorgsmaatregelen in acht waren genomen, welke de schadelijke werking van dat gebrek hadden kunnen voorkomen, en dat hij had mogen verwachten dat die voorzorgsmaatregelen wel in acht zouden worden genomen". De fabrikant dient te letten op het héle publiek 'waarvan een gedeelte het nemen van die voorzorgsmaatregelen zal nalaten'.
Hieruit is af te leiden, aan de zijde van de fabrikant:
- controleplicht
- waarschuwingsplicht (zie ook Halcion, 1989)
Het produkt dient enigermate 'idiotensicher' te zijn!
Het Hof overwoog, na terugverwijzing, dat Jumbo zelf gesteld had dat alle kruiken voor verkoop gecontroleerd werden, en dat het dus niet aangaat te stellen dat het voorkomen dat een kruik met een dergelijk gebrek in het verkeer wordt gebracht buiten het raam van de redelijkerwijs voor haar aan te nemen mogelijkheden lag. Bewijs dus overbodig. Jumbo heeft zich aan zijn eigen stellingen 'opgehangen'.
