Noch de aard, noch de opzet van de overeenkomst met Portugal verzet zich ertegen dat een marktdeelnemer zich voor een rechterlijke instantie in de Gemeenschap op een bepaling van de overeenkomst beroept.
Artikel 21 van de overeenkomst EEG – Portugal, bevat een onvoorwaardelijk verbod op belastingdiscriminatie, dat geldt zodra wordt vastgesteld dat onder een bepaalde belastingregeling vallende productie gelijksoortig zijn, en waarvan de grenzen rechtstreeks uit het doel van overeenkomst voortvloeien. Deze bepaling kan als zodanig door een rechter worden toegepast en kan dus rechtstreekse werking hebben in de Gemeenschap.
