Casus
Een bestuurder ziet bepaalde documenten openbaar gemaakt, dit schaadt haar belangen.
Botsing van twee fundamentele rechten; Ten eerste het recht om je te mogen uiten, ten tweede het recht om verschoond te blijven van belasting die het gevolg kan zijn van schadelijke uitlatingen.
Hoge Raad
Het Hof heeft bij zijn beschouwing relevante aspecten niet meegenomen.
Als het gaat om publicaties en uitlatingen die gericht zijn tegen het optreden van een wethouder, behoort dit tot het publieke forum. Hiervoor geldt in de algemene zin een ruime uitingsvrijheid en smalle beoordelingsmarge aan de hand van art. 10 EVRM en art. 6:162 BW.
Er dient een belangenafweging plaats te vinden aan de hand van alle relevante omstandigheden. Het gaat hier om oordelen van feitelijke aard, iets waar de Hoge Raad niet over gaat.
