Keesmeekers/Driesen - Arrest

Casus:

Keesmeekers heeft een perceel gekocht waarvan een aanbouw niet mee is verkocht. Keesmeekers stelt rechthebbende te zijn op de (gehele) aanbouw aan het, hem in eigendom toebehorende, pand omdat de gehele uitbouw door horizontale natrekking bestanddeel van dat pand was geworden, hiernaast vordert hij een erfdienstbaarheid tegen schadeloosstelling als bedoeld in art. 5:54 BW. Ook wil Keesmeekers een vergoeding voor de geleden schade als gevolg van een het slopen van de aanbouw die aan het pand van Keesmeekers gevestigd was. Driesen heeft op de plaats van de aanbouw een scheidsmuur opgetrokken. Driessen die eigenaar is van de aanbouw stelt dat Keesmakers bij de koop op de hoogte was dat de aanbouw niet bij de koop inbegrepen was.  Voordat Keesmeekers en Driessen de percelen kochten waren beide percelen in eigendom van een persoon.

Rechtsregel:

Het is niet mogelijk dat een eigenaar van een perceel zich tegelijkertijd gedraagt als beperkt gerechtigde tot datzelfde perceel. De verjaringsregeling wordt door de combinatie van die hoedanigheden - eigenaar van het dienende erf en gebruiker van het heersende erf – uitgesloten omdat in deze situatie niet gesproken kan worden van een (ondubbelzinnig) bezit van een erfdienstbaarheid.
